    Appellate Law

    Losing at the trial level in criminal court can be devastating. Filing an appeal is a chance to correct significant errors, whether they be procedural or substantive. An appeal process allows losing parties a chance for higher court review, and possible corrections of previous trial court decisions. It is important to note that an appeal is not a retrial of the same case in the higher court. It is more so a reevaluation to find possible legal errors based upon evidence already presented at trial.     Civil Appeals
    Appellate work, in any case, requires sophisticated legal reasoning performed by a skilled attorney. As attorneys with experience in both trial courts and appeals courts, we are prepared to analyze your case, assemble the required "record on appeal," file all briefs and provide an oral argument. We will not hesitate to tell you if we advise against filing an appeal. Additionally, we can file petitions for writ of mandate to the court of appeals for interim orders that are not appealable.
    Criminal Appeals
    Individuals convicted of a crime have the right to an appeal. Criminal appeals are time-sensitive because sentences in a criminal case often involve incarceration. Spending even one day in custody as a result of a wrongful conviction is a travesty. MLTA Law will do everything possible to prevent unnecessary incarceration time by isolating the most meritorious issues for the appeal and submitting a persuasive brief intended to grab the attention of the appellate court judges.

    Matthew L. Tuck

    Matthew Tuck is CEO and Managing Attorney for MLTA Law. Tuck earned an MBA from the University of Michigan Ross School of Business, a law degree from the University of Detroit-Mercy School of Law, and a BA in history and political science from Albion College.

    After law school, Tuck spent 17 years as a litigator in personal injury and commercial litigation cases, an appellate attorney, and a law firm IT director. Then in 2008, he pivoted from traditional legal practice and into legal technology. He worked, first, as Litigation Support Manager for Honigman, Miller Schwartz, and Cohn, an Am Law 200 firm in Detroit where he managed eDiscovery and large litigation matters. After Honigman, he then became a fractional CEO, CFO, and COO for law firms and startups. A life-long “techy” and entrepreneur, Matthew brings a wealth of legal, business, financial and technological experience to the firm.

    • In The Matter Of The Personal Restraint Of Ali, PUBLISHED CASE, No. 95578-6, Washington Supreme Court (September 17, 2020): The Washington Supreme Court Held That Houston-Sconiers Constitutes A Significant And Material Change In The Law That Requires Retroactive Application. The Court Determined That Petitioner Established Actual And Substantial Prejudice And Remanded The Case Back To Superior Court For Resentencing. This Case Established A Time Bar Exception For Incarcerated Defendants Who Were Under 18 At The Time Of Their Alleged Crime To Petition For Resentencing If They Can Establish That Youth Was Not Considered At Sentencing.
    • State V. Faghihi, No. B296826, California Court Of Appeal, 2nd District, Division 1 (August 21, 2020): Successfully Defended Respondent Against An Appeal Of A Restraining Order Imposed Against Appellant. The Court Of Appeal Concluded That The Record Overwhelmingly Supported Granting Respondent’s Request For A Permanent Restraining Order.
    • State V. Loughbom, PUBLISHED CASE, No. 97443-8, Washington Supreme Court (August 20, 2020): The Washington Supreme Court Reversed The Court Of Appeals And Remanded For The Petitioner To Have A New Trial. The Washington Supreme Court Held That The State’s Framing Of Petitioner’s Prosecution As Representative Of The War On Drugs Denied Petitioner A Fair Trial And Constitutes Reversible Error.
